AGB – Allgemeine Geschäftsbedingungen (Terms & Conditions)

These Terms & Conditions (“AGB”) apply to all orders placed by consumers (§ 13 BGB) on the website [www.quicktrolly.eu], operated by Neemcloud GmbH (“QuickTrolly”, “we”, “our”).

1. Scope of Application

These Terms & Conditions apply to all sales contracts concluded between Neem Cloud GmbH and consumers via our online shop. Deviating terms shall not apply unless expressly agreed in writing.

2. Contract Formation

  • Product listings on our website are non-binding offers.
  • By clicking the “Buy Now” button, you submit a binding order.
  • We accept the order by sending a shipping confirmation email or by dispatching the goods.

3. Prices, VAT & Delivery Costs

  • All prices are stated in Euro (€) and include statutory VAT.
  • Any shipping costs are displayed during checkout before completion of the order.
  • In case of promotions or discount codes, details will be displayed at checkout.

4. Payment Terms

We accept the following payment methods:

  • American Express
  • PayPal
  • Klarna / Sofortüberweisung
  • giropay

    • Payment is processed by secure payment service providers (PSPs). The debit of your account occurs according to the rules of your chosen provider.

5. Delivery & Shipping Terms

  • We deliver within Germany and selected EU countries (list available on our Shipping Information page).
  • Delivery is carried out by our logistics partners (e.g., DHL, DPD, Hermes).
  • Unless otherwise stated, delivery time is 2–5 working days after payment confirmation.
  • Partial deliveries are permissible if reasonable for the customer.

6. Liability & Warranty

  • The statutory warranty rights under German law apply.
  • We are liable without limitation for intent, gross negligence, and in cases of injury to life, body, or health.
  • For slight negligence, we are only liable for foreseeable damages typical for the contract.
  • We are not liable for delays or failures caused by force majeure (e.g., strikes, natural disasters, IT outages beyond our control).

7. Right of Withdrawal (Widerrufsrecht)

Consumers have a statutory right of withdrawal within 14 days (details provided in our separate Withdrawal Policy / Widerrufsbelehrung). Exceptions: perishable goods, sealed goods unsuitable for return after opening (e.g., food hygiene).

8. Governing Law

  • These Terms & Conditions are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  • Mandatory consumer protection laws of the EU country of your residence remain unaffected.

9. Dispute Resolution

The EU Commission offers an Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr/). We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
